Terms of service
Last updated 14 October 2026
These terms apply to your use of Kiteware Cloud, Kiteware Web, Kiteware Email, and Kiteware Agents (together, "Kiteware" or "the service"). By creating an account you agree to them. They are short because we would rather you read them.
Early access
Kiteware is currently invite-only. During early access we may change features, limits, and pricing. We'll tell you by email before a change affects what you pay, and nothing is charged until you choose a paid plan.
Your account
Keep your password and API keys private and tell us straight away if you think someone else has them. You are responsible for what happens under your account. One person, one account; you can create as many projects as you like inside it.
Your content
Everything you put into Kiteware, from database rows and container images to website copy and email, stays yours. We only access it to run the service, to fix a problem you've asked us about, or when the law requires it. You can export it and leave at any time.
Work done by AI
Kiteware Web and Kiteware Agents use AI models from Anthropic to write and change content for you. AI can make mistakes, so check what it produces before you publish or approve it. Nothing a Kiteware agent prepares is sent or published until you approve it, and once you approve something you are responsible for it as if you had written it yourself.
Every email an agent sends ends with a line naming the Kit and saying it is an AI agent from Kiteware. Agents send one-to-one messages only; don't use them for marketing campaigns, bulk mail, or messages to people who haven't contacted you or agreed to hear from you. Agent usage has daily and monthly limits, and agents pause when a limit is reached until it resets.
Kiteware Agents pilot
Kiteware Agents (whose agents we call Kits) is in a private pilot. Features, limits, and how it works may change while we learn from the businesses using it, and we'll tell you before a change affects you. The iPhone app is distributed through Apple's TestFlight as beta software, and Apple's TestFlight terms apply to your use of it.
Acceptable use
Don't use Kiteware to break the law, to send spam or unsolicited bulk mail, to host malware or phishing, to attack other systems, or to mine cryptocurrency. Don't try to access other customers' data or interfere with the platform. If something you run is harming the service or other customers we may pause it and will contact you.
Availability
We monitor the platform around the clock and work to keep it up, but during early access we do not offer a formal uptime guarantee or service credits. Planned maintenance is announced in advance where we can. Current status is always at kiteware.com/status.
Payment
Paid plans for every Kiteware product are billed through Stripe, on one account. Prices shown on kiteware.com are in US dollars and exclude any taxes we're required to add. Pricing for Kiteware Agents is agreed with you before you start. If a payment fails we'll email you and give you time to fix it before anything is suspended.
Ending things
You can close your account at any time by deleting your instances and agents and emailing us, and we'll remove your data. We can end your access if you break these terms; if that happens we'll tell you why and, unless the law prevents it, give you a chance to export your data first.
Liability
Kiteware is provided as is during early access. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
Changes and contact
If we change these terms in a way that matters, we'll email you before the change takes effect. Questions go to hello@kiteware.com.
